Introduction and Acceptance of Terms

Welcome to Kling4, an independent web app for generating AI videos with Kling models. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Kling4 is operated by StellarWorks LLC, located at 30 N Gould St Ste R, Sheridan, WY 82801, United States.

Kling4 is an independent service. It is not affiliated with, endorsed by, or operated by Kuaishou or Kling AI. Kling and the Kling models are developed by their respective owners, and their names and trademarks belong to those owners.

Use of the Service

Kling4 provides users with a web app to generate AI videos using Kling models, accessed through the official Kling API. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations.

User Accounts and Registration

  1. Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process.

  2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  3. User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Content and Intellectual Property Rights

All content provided through Kling4, including but not limited to generation tools, software, and documentation, is protected under copyright law. The Kling4 service is owned by StellarWorks LLC. The Kling models are owned by their respective developers.

  • You acknowledge that you do not own the underlying technology or intellectual property that makes up the Kling4 service, and you agree to respect the intellectual property rights of StellarWorks LLC and any third parties.
  • While you retain ownership of your generated content, the core Kling4 platform remains the property of StellarWorks LLC.

Prohibited Activities

You agree not to engage in any of the following prohibited activities while using Kling4:

  • Unauthorized access to or distribution of our proprietary software or the underlying models
  • Reselling or redistributing access to Kling4 without authorization
  • Interfering with or disrupting the security or performance of the service
  • Using the service for any illegal or unauthorized purpose
  • Attempting to bypass any security features of the service
  • Generating, uploading, or distributing sexually explicit, pornographic, obscene, non-consensual intimate, or other NSFW content
  • Generating or distributing child sexual abuse material (CSAM), sexualized depictions of minors, or any content that exploits or endangers children
  • Generating or promoting graphic violence, gore, terrorism, threats, harassment, or hatred against people or protected groups
  • Creating or distributing deceptive deepfakes, impersonations, or synthetic media that uses a real person's likeness or voice without authorization or misleads others about its origin or authenticity
  • Infringing or facilitating the infringement of any copyright, trademark, publicity, privacy, or other third-party right

Reporting Violations

If you believe content generated, uploaded, or shared through Kling4 violates these Terms or infringes your rights, email support@kling4.video with the subject line "Content Report." Include the relevant URL, task or account information, a description of the issue, and any supporting evidence available to you. For copyright or trademark reports, identify the protected work or mark and explain the basis of the claimed infringement.

Content Moderation and Enforcement

Prompts may be screened with automated content-safety tools before generation. We may also manually review user reports and the relevant prompts, inputs, outputs, or account activity when needed to investigate suspected violations, subject to our Privacy Policy and applicable law.

If we determine that content or conduct violates these Terms, we may block a generation request, remove or restrict content, issue a warning, limit features, suspend or terminate an account, preserve relevant records, or report unlawful conduct to the appropriate authorities where required by law. Enforcement decisions may consider the context, severity, and recurrence of the violation. You may request review of an enforcement decision by emailing support@kling4.video.

Privacy and Data Collection

Kling4 collects the following types of data:

  • Account Information: Information you provide when creating an account
  • Usage Details: Data related to your activity on our service
  • Device Information: Information about the device you use to access our service
  • Cookies: Data that helps us enhance your experience with our service

Pricing and Payments

  • You may request a refund for a new purchase within 3 days if none of the credits granted by that purchase have been used
  • Once any purchased credit has been used, or after 3 days, the purchase is non-refundable unless otherwise required by law
  • Subscriptions renew automatically until cancelled, and renewal charges are non-refundable
  • Filing a chargeback or payment dispute may result in your account being suspended or permanently banned; please contact support first
  • Full refund terms are set out in our Refund Policy
  • Prices are subject to change with notice to users
  • You agree to pay all charges associated with your selected plan
  • Payment terms are based on your selected payment method and plan

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.

Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, or availability of the service and disclaim all warranties to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, StellarWorks LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service.

Indemnification

You agree to indemnify and hold harmless StellarWorks LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the service or violation of these Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which StellarWorks LLC operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the service will be resolved through binding arbitration in accordance with applicable laws.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after any changes signifies your acceptance of the new terms.
